Bankruptcy

We understand that people have financial difficulties for reasons that are often not their fault.  Contrary to media reports, many bankruptcies are the result of the loss of a job, divorce, or catastrophic injury or accident, or major medical condition.  Some bankruptcies are a result of excessive credit card debt.  Maine’s economy has taken a severe hit in recent years, and our law firm’s increasing frequency of bankruptcy filings is confirmation of the hard times that have fallen on many families and individuals. Our attorneys will help these people with one of two types of bankruptcy filings – a Chapter 7 or a Chapter 13.

Chapter 7 bankruptcy is also known as a “liquidation” bankruptcy.  Debts are eliminated, some assets are liquidated.  It is a chance to wipe the slate clean and start over.  Persons filing for Chapter 7 may keep (exempt) many possessions including a car worth $5000 and $35,000 in equity in a home.  A married couple may retain $70,000 worth of equity in their home.

Chapter 13 bankruptcies are also known as a wage-earner or reorganization/rehabilitation bankruptcy.  Debts are placed into the care of a trustee, some are reduced or the interest rate is changed, and the person filing bankruptcy pays the debts off over time.  More assets may be retained when an individual chooses this option and the persons credit rating may recover sooner.

Family Law

Social Security Disability Claims
Because of the types of industry we have in Bangor and Mid-Maine, we see a lot of individuals in need of Social Security Disability.  Our residents have repetitive work in pulp and paper mills, and dangerous work in logging and fishing industry.  When there is no other safety net, a Social Security Disability claim is of utmost importance.  We regularly work with clients to receive coverage if their Social Security claim has been denied.
